On Tuesday, the French government announced the final version of the bill “to improve immigration control and integration” after sending it to the Council of State on Monday.

The text, which was published by the French media and defended in particular by the Minister of the Interior, Gerald Darmanin, aims, on the one hand, to facilitate the expulsion of people in an illegal situation and to open the possibility of hiring migrants in certain places. fields.

If the State Council approves the text, it will then be submitted to the Council of Ministers in January and examined in the Parliament early next year.

According to the Minister of Interior, who gave an interview to “Le Figaro”, the project consisting of 25 articles will be based on the principle of “firmness and humanity” defended by Emmanuel Macron.

– Fight illegal labor of people in illegal situations

While existing laws already severely crack down on the use of illegal workers, the new draft will go further by introducing a €4,000 fine for hiring people in an illegal situation. If there is a repeat violation within two years, the fine will be doubled this time.

Another topic that has caused a great reaction from associations defending the rights of migrants is the possibility of immediate removal from French territory of a person in an illegal situation accused of serious violence against a police officer, proven domestic violence, robbery, theft. thefts committed with the help of minors or thefts committed at a gathering in a residential area.

The “Respect for the Principles of the Republic” section enacted by the “Law Confirming the Respect for the Principles of the Republic” will apply to those who apply for a residence permit, regardless of whether it is for the first time or for an extension.

“The principles of the republic include freedom of expression and conscience in the sense of Article 2 of the Constitution, equality between citizens, especially equality of women and men, freedom of sexual orientation, dignity of human personality, symbols of the republic. the fact of not using one’s convictions or beliefs to exempt oneself from the general rules governing relations between public services and individuals,” the text further clarifies.

Similarly, those who have received an obligation to leave French territory (OQTF) within the five years preceding the application will not be able to apply for a visa for France.

– Fight against sleep traders and smugglers

The project, which also wants to crack down on slum owners, people who rent unsanitary accommodation to people in difficult circumstances at exorbitant prices, now provides for fines of up to 150,000 euros and 5 years in prison.

Likewise, persons transporting illegal immigrants in their cars, including in the Schengen area, will be fined 10,000 euros.

Associations fear that this substance will be used against them when they come to the aid of migrants in distress.

But above all, the project specifically targets smugglers, with fines of up to 1.5 million euros and 20 years in prison.

– Involve healthcare workers

For months, some trade representatives have been calling on the government to regularize people working in informal and labor-scarce sectors.

The government has already announced such a device that would allow it to create a “residence permit for high-pressure jobs”. This applies to healthcare workers. Although the government refuses to reinstate unvaccinated medical workers, it wants to open the way for the employment of foreign medical workers, but only for public or private non-profit institutions. The government actually wants to create a new perennial. Finally, the draft also envisages two major changes to the care of migrants who arrive in France illegally and are held in waiting areas. Indeed, until now, judges had to decide within 24 hours the status of these immigrants, who could apply for asylum or face deportation at the border.

Due to tight deadlines, several immigrants who arrived on the Ocean Viking last November were released. After that, this period will be increased to 48 hours. On the other hand, detention of any juvenile under the age of 16 will now be prohibited.
